1. Who collects your personal data?

Insumos Cerveceros Artesanales S.A. DE C.V. and affiliated companies or subsidiaries (hereinafter "ICAR INGENIERIA"), with address to hear and receive notifications in SUR 6 MZ 7 LT 14 B1, ZONA INDUSTRIAL TIZAYUCA, CP.43800, TIZAYUCA, HIDALGO; is the Data Controller of the personal data provided to you by the Holders to whom they correspond. For the purposes of the provisions of the Federal Law on the Protection of Personal Data in Possession of Individuals (the "LFPDPPP") and other applicable legislation, this Privacy Notice (hereinafter "Notice") sets out the terms and conditions under which the processing of the personal data of the Holders is conducted.

The Owner states (i) that this Notice has been disclosed to him/her by the Data Controller,(ii)having read, understood and agreed to the terms set forth in this, (Notice, so he/she gives his/her consent to the processing of his/her personal data. In the event that the personal data collected include economic or financial data, by signing the corresponding contract, either in printed form or using electronic means and their corresponding processes for the formation of consent, acts constituting the express consent of the holder and(iii)that gives his consent for the Responsible to make transfers and / or remissions of personal data in accordance with the provisions of paragraph 5 of this Notice will be carried out.


2. What personal data do we process?

ICAR Ingeniería may collect personal data of the Owner by direct and / or personal delivery by any means of contact between the Owner and the Responsible. It may also collect personal data indirectly through publicly accessible sources and other sources available on the market.

To carry out the purposes described in this Notice, ICAR Ingeniería will process personal identification data, contact details and economic and/or financial data. In addition, sensitive data related to the products it markets that could reveal aspects concerning the health status of the Owner and in some of its facilities biometric data.


3. For what purposes will we use your personal data? Primary Purposes.

ICAR INGENIERIA will process the personal data of the Owner in order to comply with the obligations originating and arising from any legal and commercial relationship established in connection with the preparation, production, marketing, distribution, import and export of different goods and the provision of related services requested by the Owner (collectively referred to as "the products"); to facilitate medical guidance, the supply of medicines; to carry out the payment processes; on-site service; online shopping; billing; collection; credit; contact customers; attention to doubts, clarifications, suggestions, returns and administration of websites and computer applications. Also, for activities related to the control of access and safeguarding of material and human resources within the facilities of the Responsible.

Secondary Purposes. ICAR INGENIERIA will process the Personal Data of the Owner for other purposes that allow and facilitate to provide better attention to you, as well as products specially aimed at your preferences and needs. These purposes are to send notifications of offers, notices and/or promotional messages; communications for marketing, advertising or telemarketing purposes about new or existing products and services whether own or from business partners; newsletter subscription; conducting surveys; statistics; market studies, records and histories on consumption habits, interests and behavior through automatic data capture tools; realization of loyalty programs, benefits and incentives; participation in social networks, chats and/or discussion forums; participation in events, trivia, contests, raffles, games and sweepstakes; evaluation of the quality of the products; and in general for any activity aimed at promoting, maintaining, improving and evaluating their products.

You can object to the processing of your data for secondary purposes through the means made available to you for the exercise of your ARCO rights. If you do not object within five business days after your data was collected, your consent will be understood to have been granted.


4. What was video recording on the premises for?

Anyone entering the ICAR INGENIERIA facility may be video-recorded by the security cameras. The images captured by the cameras of the CCTV system will be used for your safety and of the people who visit them, for the purpose of remotely monitoring the properties and, confirm in real time any conditions of risk to minimize it. In addition, in order to safeguard material and human resources within the facilities.


5. Who do we share your information with?

ICAR INGENIERIA does not sell, transfer, transfer, rent or give to third parties personal information collected for the previously mentioned purposes, at the time of registration or when making transactions with its servers.

6. How can you access, rectify or cancel your personal data, or object to its processing?

You may at any time exercise your ARCO rights (access, rectification, cancellation or opposition) in respect of your personal data by submitting a request in the format that for this purpose we will deliver to you, the same that must contain the following information and documentation:

  • Name of the Holder and address or other means to communicate the response to your request.
  • The current documents proving your identity (simple copy in printed or electronic format of your voter's credential, passport or Visa Fm2 or Fm3) or, where applicable, the legal representation of the Holder (simple copy in printed or electronic format of the simple power letter with autograph signature of the Holder, the representative and their corresponding official identifications in force: voter's credential, passport or Visa Fm2 or Fm3).
  • The clear and accurate description of the data for which you seek to exercise any of the ARCO Rights, and
  • Any other element or document that facilitates the location of the Owner's personal data.

In the case of requests for rectification of personal data, the Owner must also indicate the modifications to be made and provide the documentation that supports his request.

In order to comply with the obligation of access to your personal data, it will be made prior accreditation of the identity of the holder or personality of the representative; making the information available on site at the Address of the Responsible. Another means may be agreed between the Owner and the Responsible provided that the requested information permits.

To exercise your ARCO rights, the revocation of your consent and the other rights provided for in the LFPDPPP we provide you with the following means:

ICAR INGENIERIA will respond to the Holder within a maximum period of twenty working days, counted from the date on which the request was received so that, if appropriate, it will take effect within fifteen working days of the communication of the response. In all cases, the response will be given by the same way by which you have submitted your application or, where applicable by any other means agreed with the Holder. The above-mentioned deadlines may be extended in terms of the LFPDPPP.


7. How can you limit the use and disclosure of your personal data?

ICAR INGENIERIA will retain the Personal Data of the Owner for as long as necessary to process its requests for information and the products it requests, as well as to maintain the accounting, financial and audit records in terms of the LFPDPPP and the commercial, tax, administrative and any other current legislation that applies.

The personal data collected will be protected by appropriate administrative, technical, and physical security measures against damage, loss, alteration, destruction or unauthorized use, access or processing, in accordance with the provisions of the LFPDPPP and other applicable legislation. However, the above, ICAR INGENIERIA does not guarantee that unauthorized third parties will not be able to access the physical or logical systems of the Owners or the Responsible or in the electronic documents and files stored in their systems. Consequently, ICAR INGENIERIA will not be liable in any case for any damages that may arise from such unauthorized access.

You or your duly accredited legal representative may limit the use or disclosure of your personal data through the same means and procedures provided for the exercise of ARCO Rights. If your request is appropriate, you will be registered in the exclusion list provided by ICAR INGENIERIA to stop receiving information regarding advertising or marketing campaigns.

If you believe that we have in any way violated your right to the protection of your personal data, you may go to the National Institute of Transparency, Access to Information and Protection of Personal Data ("INAI").


8. What data do we collect when browsing our sites and websites?

ICAR INGENIERIA may collect data through its websites, or by using automatic data capture tools. These tools allow you to collect the information your browser sends to such websites, such as the type of browser you use, the user language, access times, and the IP address of websites that you used to access ICAR INGENIERIA sites.

ICAR INGENIERIA may collect personal data of the Owner by direct and / or personal delivery by any means of contact between the Owner and the Responsible or its Processors.
